EPA Grants the State of Texas Primacy to Protect Underground Water Resources

  • The EPA approved the state of Texas’s request for “primacy” over permitting for Class VI underground injection wells under the Safe Drinking Water Act

  • The EPA determined that Texas’s UIC Class VI program meets all federal technical and legal requirements and is capable of implementing and enforcing the program consistent with the SDWA.

  • The final rule becomes effective 30 days after Federal Register publication; with this approval, Texas will have streamlined authority (via the Railroad Commission of Texas) over Class VI wells, potentially accelerating investment in CCS

  • Texas is among Louisiana, West Virginia, North Dakota, and Wyoming with primacy
