EPA Grants the State of Texas Primacy to Protect Underground Water Resources
The EPA approved the state of Texas’s request for “primacy” over permitting for Class VI underground injection wells under the Safe Drinking Water Act
The EPA determined that Texas’s UIC Class VI program meets all federal technical and legal requirements and is capable of implementing and enforcing the program consistent with the SDWA.
The final rule becomes effective 30 days after Federal Register publication; with this approval, Texas will have streamlined authority (via the Railroad Commission of Texas) over Class VI wells, potentially accelerating investment in CCS
Texas is among Louisiana, West Virginia, North Dakota, and Wyoming with primacy

ADM begins carbon capture with Tallgrass in Nebraska
Archer Daniels Midland Company (ADM) and Tallgrass Energy have officially launched operations at their new carbon capture facility at ADM’s Corn Processing Complex in Columbus, Nebraska, marking it as the world’s largest bioethanol carbon capture project
The project captures CO2 creating during ethanol production and transports it via Tallgrass’s Trailblazer pipeline to eastern Wyoming for permanent storage.
As part of the project, Tallgrass installed a lateral connection from ADM’s plant using voluntary easements from landowners, emphasizing community cooperation and voluntary participation in the infrastructure build-out
